The Local Jobs First policy and guidelines were updated and refreshed to strengthen policy outcomes and simplify application for agencies and industry. This includes improved guidance and processes for the Major Projects Skills Guarantee (MPSG) and a new MPSG Policy Statement to complement the Local Jobs First policy.

Transitional arrangements for MPSG project tenders released between 10 October 2022 and 31 January 2023

From 31 January 2023, the process for estimating labour hours will be streamlined so that the bidder submits a single employment commitment in the Local Industry Development Plan which will be used to inform both the MPSG and VIPP requirements.

As a result of this change, bidders will no longer be required to use the Deemed Hours Formula to estimate the minimum MPSG 10 per cent requirement. A simplified and updated Deemed Hours Formula will be available for optional use by suppliers and agencies.

Tenders released between 10 October 2022 and 31 January 2023 must use the previous guidance for using the Deemed Hours Formula to calculate the MPSG requirement as outlined in the May 2020 Local Jobs First Agency Guidelines and Supplier Guidelines.

Important changes were introduced to the Local Jobs First Policy to strengthen outcomes for the local steel industry. This included a new process that suppliers and agencies delivering new and existing Strategic Projects must follow for proposed changes to local sourcing of goods, materials or labour in the project Local Industry Development Plan (LIDP).

The Local Jobs First Policy and guidelines were updated with a range of policy enhancements to ensure ease of use for suppliers and encourage participation on government projects across construction, goods and services. This update included changes to the administration of LIDPs.

On 15 August 2018, the Victorian Parliament passed the Local Jobs First Act 2003. This amended the previous Victorian Industry Participation Policy Act 2003.

For projects at tender or in contract to 15 August 2018

The Victorian Industry Participation Policy Act 2003, VIPP agency and supplier guidelines (2016), and where applicable the Major Projects Skills Guarantee (MPSG) guidelines (2016), including model clauses, will continue to apply to projects where contracts have been entered into by 15 August 2018.

All agencies must continue to ensure that contractors deliver their commitments as specified in VIPP Plans, Local Industry Development Plans (LIDP), and MPSG Compliance Plans within existing contracts.

Compliance will continue to be the responsibility of the procuring agency and project contractor or supplier, and DJSIR will continue to have oversight, monitoring, reporting and compliance responsibilities, including auditing of completed projects or those in progress.

For projects tendered from 15 August 2018

The Local Jobs First Act 2003, the Local Jobs First Policy and related Local Jobs First Guidelines (including model clauses) will apply to all projects put to tender from 15 August 2018. Documentation may need to be updated to reflect these requirements and tender periods may need to be extended to give industry sufficient time to respond.

Compliance will continue to be the responsibility of the procuring agency and project contractor or supplier, and DJSIR will continue to have oversight, monitoring, reporting and compliance responsibilities, including auditing of completed projects or those in progress.

The Local Jobs First Commissioner’s functions and powers will also apply to these projects.
